Legal Notice
Privacy Policy
Article 1. Purpose and scope
. The purpose of this Privacy Policy is to inform Users of the conditions governing the collection and processing of their personal data in connection with their use of the Publisher’s websites and services under the brand name “EDUCPAD” (which is a registered trademark), as well as regarding the Publisher’s compliance with its obligations, which ensures that it takes the necessary legal and customary precautions, and finally to set out the rights and obligations of the Parties in this context.
. This privacy policy is accessible on the Website at any time whilst you are browsing. It is deemed to be up to date, is the only one that is legally binding, and applies under the same conditions as the General Terms and Conditions of Use of the relevant website.
. The domains concerned are: https://educpad.com
Article 2. Purpose of data collection
. The purpose of data processing is to enable the Publisher to optimise the management of its relationships with its Users and Customers, as well as the technical efficiency of the experience on the Site(s), which includes in particular: browsing, navigation, registrations, making contact, generating quotes, subscriptions and sales, and the use of any software features.
. Furthermore, and in a transparent and explicit manner, the collection and processing of data may also be carried out for the purpose of sending newsletters and/or commercial communications.
Article 3. User Consent
. An information banner appearing at the entrance to the Website reminds the User that their consent to this privacy policy is deemed to have been given by continuing to browse the site, whether by scrolling down the page in question or by clicking on any link on the Website. These voluntary actions unequivocally indicate the User’s consent to the use of cookies and to this privacy policy in its entirety.
. However, the User gives their explicit and unequivocal consent (opt-in), through any legal means (tick box or other), when data concerning them is collected for the purpose of sending newsletters and/or commercial communications.
. The User is informed in a transparent manner of the use of cookies and any data collection, via a notice permanently displayed at the bottom of the Site.
. The Publisher certifies that at no time and in no way, whether directly or indirectly, does it collect data without informing the User.
Article 4. Scope of data collection
Article 4.1. Data collected when visiting the Website
. When the User views the basic information pages of the Website, the Publisher collects by default only the data strictly necessary for such viewing: data relating to the IP address (identification of your internet connection and your device) and the pages viewed.
Article 4.2. Data collected when using the Site’s features
. The data processed via the forms available on the Website, for the purpose of sending the User newsletters and communications (including commercial ones), or generating online quotes, includes the following information, the mandatory or optional nature of which is indicated directly online: valid email address, a free-text field, telephone number, surname and first name, and the option to add an attachment where applicable (in jpeg, png or pdf formats only).
. The User may interact with third-party websites and applications, in particular by clicking on the social media buttons present on the Website(s). The User acknowledges that this action results in the transfer of information to the relevant third-party sites, and that they are responsible for their contractual relationships with such sites (profile, privacy settings). Under no circumstances shall the Publisher be liable for any damage resulting from the use of this process.
. In all cases, the User undertakes to provide only complete, accurate and valid information, which is presumed to be the case by the Publisher, who disclaims liability for any breach of these obligations by the User, and reserves the right to carry out any necessary checks, including via any additional supporting documents.
. Similarly, the User acknowledges that their failure to provide mandatory information entitles the Publisher to refuse to provide, suspend or terminate any Service provided to them.
Article 5. Use of cookies
. The operational functioning of the Website requires the use of cookies, which are small ‘tracking’ software files installed on the User’s device, and which, in this case, only provide the Publisher with access to standard connection information.
. All information collected will be used solely to monitor the volume, type and configuration of traffic passing through the Site(s), to develop their design and layout, and more generally to improve navigation.
. Cookies do not collect any personal data that could identify you, either on your hard drive or online, and the information collected is encrypted and anonymous, notably via the Lets Encrypt SSL certificate.
. These cookies are stored in and managed by your own web browser. If you wish to refuse these cookies, please consult your web browser’s privacy settings.
. The Publisher recommends that Users configure their settings to accept these cookies, thereby facilitating the browsing and use of the Website.
. The User is therefore free to choose in their browser settings whether or not to accept cookies. If they do not accept them, they unreservedly acknowledge that they cannot hold the Publisher liable for any difficulties they may encounter whilst browsing, which may make it difficult or even impossible to use the Website as a whole.
Article 6. Data Security
. The Publisher undertakes to take all necessary precautions to safeguard the security and confidentiality of the processing and of the data collected, in accordance with physical and logical security standards (protection of premises, protection of servers, etc.).
. In particular, the Publisher implements measures to prevent the data being processed from being distorted or damaged, or from being accessed by unauthorised third parties.
Article 7. Confidentiality of processing
. The connection data collected whilst you browse the site through the use of cookies is anonymous or anonymised, and does not allow access to, nor the storage or handling in any way whatsoever, of personal data concerning Users that would enable their identification.
. Regardless of the type of data collected, the Publisher does not disclose the collected data to any third party whatsoever, in any form whatsoever, with the legitimate exception, and on a strictly confidential basis, of the persons mentioned below:
– The Publisher and/or its staff, whether employees or subcontractors;
– The technical service provider(s) responsible for maintaining the Website, as well as third parties authorised by law (in particular upon the express and reasoned request of judicial authorities, accounting authorities, etc.).
Article 8. Data retention
. The data collected is lawfully retained for the entire duration of any commercial relationship between the Parties.
. The retention periods for the data collected vary depending on the type of data, which is subject to different legal and regulatory requirements (allowing for longer retention or, conversely, requiring its deletion). In any event, this corresponds to the need for the Parties to fulfil their contractual obligations.
. The following retention periods therefore commence from the end of the commercial relationship: they are set at thirteen (13) months for connection data and potential audience measurement data (in particular, cookies), fifteen (15) months for bank details, and a maximum of three (3) years for other types of data.
. As an exception, the retention period applicable to identity documents provided is one (1) year, unless the User exercises their right to object, in which case the period is extended to three (3) years.
. Data is retained for the purposes of improving the use of the Website(s), optimising the commercial relationship, ensuring secure browsing, and as evidence of the Publisher’s commercial activities.
. The Publisher undertakes, at the end of this period, to seek the User’s express consent to continue processing their data (Opt-in), or, during this period and upon the User’s unequivocal request, to cease sending any newsletters and all commercial communications (Opt-out).
. After this period, any archiving on a separate electronic medium is permitted by law but may only be carried out for evidential purposes and with strictly limited access.
. The Publisher undertakes to comply with any justified request to access, amend, object to, and/or delete the said data, responding to such requests within thirty (30) calendar days of receiving the request. Such requests must be made by email to contact@educpad.com, and will be confirmed by an email acknowledging receipt and the processing of the request.
. For security reasons and to prevent fraudulent requests, the Publisher may validly require that such a request be accompanied by proof of identity, which it will delete or destroy after processing the request.
Article 9. Content moderation by the Publisher
. The Publisher actively moderates any content published on the Website(s), in particular via any form, and reserves the right, at any time and without having to justify its decision, to remove:
– any information that may disrupt the functioning of the Site(s)
– any information constituting or inciting verbal abuse, threats of physical violence, discrimination of any kind, hate speech, insults, defamation, offences against public decency and public order, commercial offers and canvassing, offences relating to child pornography, or terrorism.
– any information that breaches these Terms and Conditions, national or international laws, or the rules of netiquette.
. For any queries or reports, the User may at any time send a message to contact@educpad.com.
Article 10. Dispute Resolution
Article 10.1. Complaints
. Any complaint by the User must be addressed to the Publisher by post or email to contact@educpad.com. In the absence of a response within a maximum of thirty (30) days, or in the event of a dispute regarding the response, the User may resort to a conventional mediation procedure or any alternative dispute resolution method, without prejudice to any mandatory legal proceedings.
Article 10.2. Jurisdiction
. In the absence of an amicable resolution of any disputes, and in the absence of an express agreement between the Parties, disputes relating to the use of the Website, and to this Privacy Policy concerning its validity, interpretation, performance, consequences and effects, shall be subject to the exclusive jurisdiction of the court chosen by the publication manager for Users who can demonstrate professional status, and in accordance with the applicable rules in all other cases.
